Acceptable Use Policy

1. Overview

This Acceptable Use Policy (“AUP”) governs your use of the products, services, and platform provided by ARX QM Holdings, Inc. (“ARX,” “we,” “us,” or “our”). This AUP is incorporated by reference into our Terms of Service and applies to all users, including individuals, organizations, and developers accessing our Services through any means, including our platform, APIs, and integrations.

We may update this AUP from time to time. Material changes will be communicated with at least 30 days’ notice. Continued use of our Services after changes take effect constitutes acceptance.

2. Universal Prohibitions

You may not use the Services to:

2.1 Illegal Activities

  • Violate any applicable local, state, national, or international law or regulation
  • Facilitate, promote, or engage in any form of illegal activity, including fraud, money laundering, or terrorist financing
  • Generate content that constitutes child sexual abuse material (CSAM) or exploits minors in any way
  • Traffic in illegal goods, substances, or services
  • Evade sanctions, export controls, or trade restrictions

2.2 Harmful or Abusive Content

  • Generate, distribute, or facilitate content that promotes violence, hatred, harassment, or discrimination against any individual or group
  • Create content designed to harass, bully, threaten, stalk, or intimidate others
  • Generate non-consensual sexual content or deepfakes of real individuals
  • Produce content that exploits or endangers vulnerable populations
  • Create or distribute disinformation, including synthetic media designed to deceive

2.3 Deceptive Practices

  • Misrepresent AI-generated content as human-created where such disclosure is required by law or regulation
  • Use the Services to impersonate individuals, organizations, or government entities
  • Create phishing, social engineering, or scam content
  • Generate fraudulent reviews, testimonials, or endorsements
  • Manipulate or deceive individuals into taking actions against their interests

2.4 Security and Infrastructure Abuse

  • Attempt to gain unauthorized access to our systems, accounts, or infrastructure
  • Probe, scan, or test the vulnerability of our systems without express written permission
  • Interfere with, disrupt, or degrade the performance or availability of our Services
  • Circumvent, disable, or bypass rate limits, access controls, safety mechanisms, or other protective measures
  • Deploy malware, ransomware, viruses, or other malicious code through our Services
  • Use the Services to conduct denial-of-service attacks or similar disruptive actions against any party

2.5 Intellectual Property Violations

  • Use the Services to infringe upon copyrights, trademarks, patents, trade secrets, or other intellectual property rights of any party
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or architecture of our Services
  • Scrape, crawl, harvest, or extract data from our platform beyond what is permitted through our APIs
  • Use outputs from our Services to train, fine-tune, or develop competing AI models or services without express written permission

3. High-Risk Use Restrictions

The following uses require prior written authorization from ARX and may be subject to additional terms, safeguards, and human oversight requirements:

  • Healthcare and Medical: Clinical decision-making, diagnosis, treatment recommendations, or any use that constitutes the practice of medicine
  • Legal: Providing legal advice, drafting binding legal documents, or any use that constitutes the practice of law
  • Financial: Investment advice, credit decisions, insurance underwriting, or any use subject to financial regulations
  • Critical Infrastructure: Direct control or management of power grids, water treatment, transportation systems, or other critical infrastructure
  • Automated Decision-Making: Decisions that produce legal effects or similarly significant effects on individuals without meaningful human review
  • Government and Law Enforcement: Surveillance, predictive policing, criminal risk assessment, or immigration-related decisions
  • Weapons and Dual-Use: Development, design, or control of weapons, military systems, or dual-use technologies

4. Developer and API Usage

If you access our Services through APIs or build applications on our platform, you additionally agree to:

  • Comply with all applicable API documentation, rate limits, and usage guidelines
  • Implement appropriate content moderation and safety measures in your applications
  • Clearly disclose to your end users that your application uses AI-powered services where required by law
  • Not represent AI-generated outputs as human-created to your end users without appropriate disclosure
  • Ensure your end users comply with this AUP and our Terms of Service
  • Maintain reasonable security practices to protect API credentials and access tokens
  • Not exceed your authorized usage limits or attempt to circumvent rate limiting

5. Content Standards

When using our Services to generate, process, or manage content, you are responsible for ensuring that all content complies with applicable laws and this AUP. You acknowledge that AI-generated content may require human review before publication or distribution, particularly in regulated industries or contexts where accuracy is critical.

We reserve the right to remove, disable, or restrict access to content that violates this AUP, without prior notice.

6. Reporting Violations

If you become aware of any use of our Services that violates this AUP, please report it to us immediately:

Please include as much detail as possible, including URLs, screenshots, and a description of the suspected violation.

7. Enforcement

Violations of this AUP may result in:

  • Warnings and requests for corrective action
  • Temporary suspension of access to the Services
  • Permanent termination of your account
  • Removal or disabling of violating content
  • Reporting to relevant law enforcement or regulatory authorities
  • Legal action to recover damages or seek injunctive relief

ARX reserves the right to investigate and take appropriate action at its sole discretion, including without prior notice where we believe there is an imminent risk of harm.
